June 19, 2010 PanARMENIAN.Net - “We can’t get in contact with the company management while XterNet clients are looking for other providers,” President of Internet Society NGO Igor Mkrtumyan told a PanARMENIAN.Net reporter. Some 40 XterNet clients have become U!Com subscribers, another 40 use the company’s hosting. “Generally, these are corporate clients. Although they have been experiencing problems with maintenance since February, they still hoped for the better,” said Aram Barseghyan, head of U!Com corporate sales department. “We offered them free hosting till December 31.” The RA Public Services Regulatory Commission promised to investigate into the issue, although having no idea of it before. 400 subscribers of XterNet were thrown over. Besides, the company owes to employees. However, the deceived users are not in a hurry to go to court. “If a company declares bankrupt, there can be no compensation,” said Angelina Andreasyan, programming engineer at Zenteq.AM, an XterNet client. XterNet’s service contract is not to the benefit of clients, to say the least. “It is a shackling agreement, protecting the company’s interests only,” said Arkady Sahakyan, a lawyer at Union of Information Technology Enterprises (UITE). “This agreement is a grave violation of human rights and international norms.” The founder of XterNet is XALT LLC, which, according to the contract, is relieved of any responsibility or indemnity claims regarding XterNet activity. Moreover, the contract empowers the company to change any provision, with further notification of clients through e-mail. “Such agreements can be appealed, as users had to sign it to their detriment,” Sahakyan said. Besides, on case the company declares bankrupt, the aggrieved parties can announce about the damage inflicted on them in the course of 2 months.
