Armenian Ombudsman says several articles anti-constitutional

PanARMENIAN.Net - Armenian Ombudsman Karen Andreasyan addressed the Constitutional Court with a demand to rule several articles on “Administrative violations” unconstitutional.

As Ombudsman's Office representative told a PanARMENIAN.Net reporter, RA citizen may be detained within ten days for having committed administrative violations.

Article 262 on “Administrative violations” is inconsistent with RA Constitution’s Article 16, under which the arrested citizen must be released unless the court issues judgment within 3 days after the arrest.

Moreover, under the Constitution, every prisoner is authorized to inform an elected person of his arrest; whereas Article 260 on “administrative violations” says that at the request of the arrested citizen, his family, place of employment or education must be informed of his whereabouts.

Thus, according to the article, keeping relatives informed is not mandatory, which runs counter to the Constitution.
