Two members of the Supreme Judicial Council (SJC), Kristine Mkoyan and Karen Tumanyan, have recused themselves from the disciplinary case concerning Administrative Court of Appeals judges Hrach Ayvazyan, Karen Avetisyan, and Court President Rustam Makhmudyan, according to Factor.am .
Mkoyan explained that she had previously dealt with the case as a judge, which is now the subject of disciplinary proceedings. Tumanyan cited close personal ties with Hrach Ayvazyan. The SJC accepted both recusal motions.
The judges under investigation did not attend the session. Their lawyer, Gnel Mughnecian, informed the Council in writing that he was unable to attend due to other commitments. Consequently, the session was postponed.
On May 20, Factor TV reported that the disciplinary action stems from the panel's interpretation of a legal provision in a judicial ruling. Under the Armenian Constitution and Judicial Code, judges cannot be held accountable for their opinions or rulings, except in cases involving criminal acts or disciplinary violations. The ruling in question was presided over by Ayvazyan, with Makhmudyan and Avetisyan as co-judges.
