
Armenia's Constitutional Court unanimously approved the procedural rules for hearing the consolidated case based on applications filed by seven political forces challenging the results of the June 7 National Assembly elections.
The court decided not to consider the issue of whether Judges Seda Safaryan and Davit Khachatryan should be disqualified from participating in the proceedings.
None of the Constitutional Court judges raised the issue of the two judges' participation in the case. Based on that, Constitutional Court President Arman Dilanyan declared the matter closed, Panorama.am reported.
"All the circumstances mentioned here have been thoroughly examined by the Constitutional Court. During the Court's procedural session, many more circumstances were discussed than were raised here.
The circumstances concerning Judge Vardanyan, Judge Zeynalyan, and Judge Safaryan are not identical and hardly coincide in any respect, except perhaps for the general connection with politics," Dilanyan said.
The Constitutional Court also rejected Aram Orbelyan's motion seeking to have the composition of the court declared unauthorized.
Dilanyan said that much would depend on the length of the hearing today and tomorrow, adding that, if possible, the court would determine with reasonable certainty when the proceedings would conclude.
Summarizing the proposals made during the session, he said the applicants would question the respondent during a separate stage of the hearing.
According to Dilanyan, there will be no time limit on the applicants' explanations. The court will not take a strict or overly formal approach and will allow speakers to finish their statements.
He also noted that there was agreement to change the order of presentations, moving the Prosperous Armenia Party's explanations to the end.
Emphasizing that the Constitutional Court will also hear the case on Saturday and Sunday, Dilanyan recalled that, once the hearings conclude, the court must retire to deliberate and issue its ruling, noting that it has only eight days to do so.
Responding to the applicants' observation that Sunday is the Feast of the Holy and Immortal Liturgy, he said the issue would be reconsidered on Saturday and added: "Please do not rule out the possibility that we will hold a hearing on Sunday as well."
Under previous procedural decisions of the Constitutional Court, Judges Artak Zeynalyan and Vladimir Vardanyan are not participating in the proceedings concerning the election results. Similar requests had also been submitted regarding Judges Seda Safaryan and Davit Khachatryan.
